Toolsy Privacy Policy

1. Who We Are

Toolsy is a peer-to-peer rental marketplace that connects people who own tools, gadgets, equipment, and related items (“Lenders”) with people who want to rent them (“Renters”).

 

Toolsy is operated by Toolsy LLC, a Wyoming limited liability company (“Toolsy,” “we,” “us,” or “our”).

This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, how we share it, and the choices you have regarding your information.
 

By creating an account, using the Toolsy app, visiting our website, joining our waitlist, or otherwise using our services, you acknowledge that you have read this Privacy Policy.

2. Who This Policy Applies To

This Privacy Policy applies to all users of Toolsy, including:
 

  • Registered users

  • Lenders

  • Renters

  • Waitlist subscribers

  • Website visitors

  • Anyone who communicates with Toolsy
     

Toolsy is intended for users who are at least 18 years old. By creating an account, you represent that you are at least 18 years old.
 

Toolsy is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly. If you believe a child has provided us with personal information, please contact us at info@toolsy.rent

3. Information We Collect

We collect information in several ways: information you provide directly, information generated through your use of Toolsy, information collected through your device, and information provided by third-party service providers.

3.1 Information You Provide Directly

Account Information
When you create an account, we may collect your full name, email address, phone number, password, and other account details. Passwords are stored in encrypted or hashed form and are not visible to Toolsy administrators.

Profile Information
You may choose to upload a profile photo and provide additional profile details. Your display name, profile photo, ratings, and certain profile details may be visible to other users as part of normal marketplace functionality.

Tool, Gadget, and Equipment Listings
When you create a listing, we collect information such as the item title, description, category, rental price, security deposit amount, availability, condition details, photos, and any other information you choose to include.

Listing photos may be publicly viewable within the Toolsy platform so Renters can evaluate available items. Do not upload photos that include sensitive personal information, home addresses, license plates, children, bystanders, financial documents, or anything else you do not want visible to other users.

Booking Information
When you make, receive, accept, decline, cancel, or complete a booking, we collect booking details, including rental dates, rental amounts, deposit amounts, item details, user information, booking status, and related transaction records.

In-App Messages
Messages sent between users through Toolsy are stored so users can communicate about listings, bookings, pickups, returns, disputes, and related matters. Messages are visible to the users participating in the conversation and may be reviewed by Toolsy if necessary to investigate safety concerns, fraud, disputes, policy violations, or legal issues.

Dispute Submissions
If you submit a dispute, damage claim, complaint, or support request, we may collect your written explanation, photos, videos, messages, transaction details, and any supporting documentation you provide.

Reviews and Ratings
If you submit a review or rating, we collect the review text, rating, related transaction context, and your user information. Reviews may be displayed publicly within the Toolsy platform. Do not include private, sensitive, false, defamatory, or unlawful information in reviews.

Waitlist and Marketing Signups
If you join our waitlist or sign up for updates, we collect your email address and any other information you provide. We may use this information to send platform updates, launch announcements, product news, and marketing communications. You may opt out of marketing emails at any time by clicking the unsubscribe link in the email or contacting us.

3.2 Optional Identity Verification

To help build trust and reduce fraud, Toolsy may offer optional identity verification. If you choose to participate, you may be asked to submit a government-issued ID photo, selfie photo, or other verification information.

Identity verification is optional unless otherwise stated for a specific feature, transaction, safety review, fraud review, or legal requirement.

Verification documents are stored in private, access-controlled storage and are not visible to other users. They may be reviewed by authorized Toolsy personnel or approved service providers for trust, safety, fraud prevention, dispute resolution, and compliance purposes.

We do not use automated facial recognition, facial geometry scanning, biometric identification, or automated face-matching technology on these files unless this Privacy Policy is updated to clearly disclose that use and obtain any legally required consent.

Unless a dispute, fraud review, legal hold, regulatory obligation, or safety issue requires longer retention, Toolsy deletes unneeded optional identity verification documents within 90 days after verification review.

3.3 Payment Information

Toolsy uses third-party payment processors, including Stripe, Inc., to process payments, security deposit holds, refunds, and Lender payouts.

Toolsy does not collect, store, or have access to your full credit card number, debit card number, CVV code, or full bank account information. Payment information is collected and processed directly by Stripe or another approved payment processor and is governed by that provider’s privacy policy and terms.

Toolsy may receive and store limited payment-related information, such as transaction IDs, customer IDs, payment status, payout status, booking amounts, deposit amounts, refunds, chargebacks, and related transaction records.

Lenders who receive payouts may be required to complete Stripe Connect onboarding or similar payment-provider onboarding. Information submitted during that process is handled by the payment provider and subject to its own policies.

Information We Collect

We collect information in several ways: information you provide directly, information generated through your use of Toolsy, information collected through your device, and information provided by third-party service providers.

3.4 Location Information

With your permission, Toolsy may access your device location to help you find nearby listings, show relevant search results, estimate distance, and improve marketplace functionality.

We do not continuously track your location in the background. We may process your approximate or precise location when you actively use location-based features, such as searching for nearby items or creating listings.

Toolsy may display your general location, such as city, neighborhood, or approximate area, to other users. We do not intentionally display your precise GPS coordinates to other users.

 

You can disable location access at any time through your device settings. If you disable location access, some location-based features may not work properly.

3.5 Information We Collect

When you use Toolsy, we and our service providers may collect technical information, including:

  • Device type

  • Operating system

  • App version

  • Browser type

  • IP address

  • Device identifiers

  • Session data

  • Error logs

  • Crash reports

  • Security and authentication data

  • Usage activity within the app or website

We use this information to operate Toolsy, secure accounts, detect fraud or abuse, troubleshoot bugs, improve performance, analyze usage, and maintain platform reliability.

3.6 Push Notifications

If you enable push notifications, we may collect and store a push notification token associated with your device. We use this token to send app notifications related to bookings, messages, account activity, disputes, reminders, platform updates, and other service-related alerts.

You can disable push notifications at any time through your device settings.

3.7 Camera and Photo Library Access

With your permission, Toolsy may access your device camera and photo library so you can take or upload:

·      Profile photos

·      Listing photos

·      Damage or dispute evidence

·      Identity verification documents

·      Other images required for app functionality

Toolsy only accesses photos or files you choose to take, upload, or submit through the app.

3.8 Analytics and Marketing Measurement

Toolsy may use analytics, crash-reporting, and marketing measurement tools to understand how users interact with the platform, improve the product, diagnose technical issues, and measure the effectiveness of marketing campaigns.

These tools may collect information such as device identifiers, app usage events, session data, referral sources, marketing attribution data, and interaction data.

We will update this Privacy Policy when we add or change material analytics or marketing measurement providers.

3.9 Information We Do Not Collect or Do Not Do

To be clear:

  • We do not sell your personal information.

  • We do not knowingly collect personal information from children under 13.

  • We do not intentionally display your precise GPS coordinates to other users.

  • We do not collect biometric identifiers such as fingerprints, facial recognition scans, or facial geometry data unless this policy is updated and legally required consent is obtained.

  • We do not store your full credit card number, debit card number, CVV code, or full bank account details.

4. How We Use Your Information

Toolsy uses your information to:

  • Create, maintain, and secure your account

  • Verify user identity, where applicable

  • Facilitate rentals between Lenders and Renters

  • Display listings and relevant marketplace content

  • Process bookings, payments, deposits, refunds, and payouts

  • Enable in-app messaging between users

  • Send booking confirmations, payment notices, reminders, messages, and account alerts

  • Send marketing communications, platform updates, and product news

  • Provide customer support

  • Investigate disputes, damage claims, fraud, abuse, or violations of our Terms of Service

  • Moderate listings, descriptions, images, messages, reviews, and other content

  • Improve platform functionality, safety, performance, and user experience

  • Analyze usage trends and marketing performance

  • Maintain business records

  • Comply with legal obligations

  • Enforce our Terms of Service and other agreements

  • Protect the rights, safety, and property of Toolsy, our users, and the public

Even if you opt out of marketing communications, we may still send transactional or service-related messages, including booking confirmations, payment notices, dispute updates, safety notices, legal notices, and account alerts.

5. How We Share Your Information

We share information only as described in this Privacy Policy or as otherwise permitted by law.

5.1 With Other Users

Certain information is visible to other users as part of normal marketplace functionality. This may include:

  • Display name

  • Profile photo

  • General location

  • Listings

  • Listing photos

  • Item descriptions

  • Rental pricing

  • Availability

  • Ratings and reviews

  • Booking-related information necessary to complete a transaction

  • Messages sent to another user

Your optional identity verification documents, payment card details, private account credentials, and non-public support communications are not displayed to other users.

5.2 With Service Providers

We share information with trusted third-party service providers that help us operate, secure, improve, and support Toolsy. These providers may only use your information to provide services to Toolsy or as otherwise permitted by their agreements with us and applicable law.
 

Our service providers may include:
 

  • Supabase, Inc. — database hosting, authentication, and file storage

  • Stripe, Inc. — payment processing, deposit holds, refunds, and payouts

  • Expo / 650 Industries, Inc. — mobile app infrastructure and push notifications

  • Google Cloud Vision API — image moderation and safety review

  • OpenAI, Inc. — automated text moderation and safety review

  • Google Workspace — email delivery

  • Google Fi SMS service — customer support tools
     

We may update this list as our service providers change.

5.3 For Legal, Safety, and Compliance Reasons

We may disclose information if we believe in good faith that disclosure is necessary to:
 

  • Comply with applicable law, regulation, subpoena, court order, or government request

  • Protect the rights, safety, or property of Toolsy, our users, or the public

  • Investigate fraud, abuse, security incidents, or policy violations

  • Enforce our Terms of Service or other agreements

  • Respond to claims, disputes, or legal process

  • Prevent harm or illegal activity

5.4 Business Transfers

If Toolsy is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, your information may be transferred as part of that transaction.
 

If required by law, we will notify users of material changes in ownership or use of personal information.

5.5 We Do Not Sell Your Personal Information

Toolsy does not sell, rent, or trade your personal information to third parties for their own marketing or commercial purposes.
 

If our practices change in a way that constitutes a “sale,” “sharing,” or targeted advertising under applicable privacy laws, we will update this Privacy Policy and provide any legally required rights or opt-out mechanisms.

6. Data Storage and Security

Toolsy uses technical, administrative, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

These safeguards may include encryption in transit, access controls, private storage for sensitive documents, authentication protections, database-level security rules, limited administrative access, and monitoring for suspicious activity.
 

Optional identity verification documents are stored in private, access-controlled storage and are not publicly visible. Listing photos may be publicly accessible within the platform as necessary to display listings.
 

No system is completely secure. We cannot guarantee absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials and should not share your password or login information with anyone.

If a data breach affects your personal information, we will notify you as required by applicable law, including the Florida Information Protection Act where applicable.

7. Data Retention

We retain personal information for as long as reasonably necessary to operate Toolsy, provide services, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, maintain business records, and protect users.
 

Our general retention practices are:
 

  • Account information: Retained while your account is active and for a reasonable period afterward as needed for legal, security, fraud-prevention, or business purposes.

  • Booking and transaction records: Retained for at least 7years for tax, accounting, financial, legal, and dispute-resolution purposes.

  • Messages: Retained while your account is active and as needed for safety, dispute resolution, fraud prevention, legal compliance, or enforcement.

  • Listings and listing photos: Retained while listings are active and for a reasonable period afterward for records, disputes, fraud prevention, and platform integrity.

  • Reviews and ratings: Retained as part of marketplace history unless removal is required by law or Toolsy policy.

  • Dispute records: Retained as long as necessary to resolve the dispute and maintain legal, safety, and business records.

  • Optional identity verification documents: Deleted within 90 days after verification review unless longer retention is required for fraud prevention, dispute resolution, legal compliance, safety review, or legal hold.

  • Push notification tokens: Deleted or deactivated when no longer needed, such as when you disable notifications, delete your account, or the token becomes inactive.
     

You may request deletion of your account and personal information as described in Section 9. Some information may be retained after deletion where required or permitted by law, including transaction records, dispute records, fraud-prevention records, legal records, and tax or accounting records.

8. Florida-Specific Disclosures

8.1 Florida Information Protection Act

Toolsy maintains reasonable measures designed to protect personal information as required by applicable Florida law, including the Florida Information Protection Act.
 

In the event of a security breach involving personal information, Toolsy will provide notices required by applicable law, including notice to affected individuals and, where legally required, notice to the Florida Department of Legal Affairs.
 

Where applicable, Toolsy will provide required notices without unreasonable delay and within the time periods required by law.

8.2 Florida Digital Bill of Rights

The Florida Digital Bill of Rights primarily applies to certain larger businesses that meet specific statutory thresholds. To the extent the law applies to Toolsy, we will comply with applicable requirements.
 

In the interest of transparency:
 

  • Toolsy does not sell your personal information.

  • Toolsy does not knowingly collect personal information from children under 13.

  • Toolsy does not use biometric data for identification unless this policy is updated and legally required consent is obtained.

  • Toolsy does not intentionally display precise GPS coordinates to other users.
     

If Toolsy begins using personal information for targeted advertising or other practices that trigger additional privacy rights, we will update this Privacy Policy and provide any legally required notices or choices.

9. Your Rights and Choices

Depending on where you live and which laws apply, you may have certain rights regarding your personal information.

9.1 Access and Correction

You can access and update much of your account and profile information directly in the Toolsy app.
 

If you cannot update certain information yourself, you may contact us at info@toolsy.rent.

9.2 Account Deletion

You may request deletion of your account by using the account deletion feature in the app or by contacting us at info@toolsy.rent.
 

We will process deletion requests within a reasonable period and within any legally required timeframe. Some information may be retained after account deletion where required or permitted by law, including information related to transactions, disputes, fraud prevention, safety, taxes, accounting, legal compliance, and enforcement of our agreements.

9.3 Marketing Emails

You may opt out of marketing emails at any time by clicking the unsubscribe link in the email or contacting us.
 

Even if you opt out of marketing emails, we may still send transactional and service-related messages.

9.4 Push Notifications

You can disable push notifications through your device settings.

9.5 Location Access

You can revoke location access through your device settings.
 

If you revoke location access, certain features may be limited or unavailable.

9.6 Identity Verification Document Deletion

If you submitted optional identity verification documents, you may request deletion by contacting us at info@toolsy.rent.
 

We may retain verification-related information where necessary for fraud prevention, legal compliance, dispute resolution, safety review, or legal hold.

9.7 California Residents

If you are a California resident and applicable law applies to Toolsy, you may have rights to:

  • Know what personal information we collect, use, disclose, sell, or share

  • Access personal information we maintain about you

  • Request correction of inaccurate personal information

  • Request deletion of personal information

  • Opt out of sale or sharing of personal information, if applicable

  • Limit use of sensitive personal information, if applicable

  • Not be discriminated against for exercising privacy rights

Toolsy does not sell personal information. If our practices change, we will update this Privacy Policy and provide any required opt-out rights.

10. Children’s Privacy

Toolsy is intended for users who are 18 years of age or older.

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly.

11. Third-Party Links and Services

Toolsy may contain links to third-party websites, services, payment platforms, app stores, or external tools. These third parties have their own privacy policies and practices.
 

We are not responsible for the privacy practices of third-party services. We encourage you to review the privacy policies of any third-party services you use in connection with Toolsy.

12. App Store and Platform Disclosures

Toolsy may be distributed through Apple’s App Store, Google Play, or other app platforms. Those platforms may collect information directly from you and may require Toolsy to provide privacy and data safety disclosures.
 

Our app store privacy disclosures are intended to match this Privacy Policy. If there is a conflict between this Privacy Policy and an app store disclosure, please contact us so we can review and correct the inconsistency.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.

When we make changes, we will update the “Last Updated” date at the top of this policy. If we make material changes, we may also notify you by email, in-app notice, website notice, or another legally required method.

Your continued use of Toolsy after an updated Privacy Policy is posted means you acknowledge the updated policy.
